General Terms and Conditions
1. Scope of application
- The Austrian National Union of Students at the Vienna University of Economics and Business (ÖH WU) provides its services in connection with the Vienna University of Economics and Business Ball (WU Ball) exclusively on the basis of the following General Terms and Conditions (GTC).
- The scope of the following GTC extends to the use of the website https://wuball.at, the purchase of admission or seating tickets for the WU Ball in the web shop and to all resulting business relationships between the WU Ball and customers.
- Before completing the online order, the customer’s attention is explicitly drawn to the GTC. By selecting the checkbox and subsequently placing the order, the customer agrees to the GTC.
- Any deviation from the GTC shall not be recognised unless WU Ball agrees to this in writing.
- WU Ball’s GTC apply in the version current at the time of the customer’s order and may be amended at any time.
2. Use of the website
- Use of the website https://wuball.at is free of charge for the user.
- Through the website https://wuball.at, the WU Ball enables users to find out about the event, purchase tickets and contact the WU Ball.
- All images and trademarks are the property of the respective trademark owners or WU Ball. They are not explicitly labelled on the website; this does not mean that they are freely usable materials.
3. Data protection and privacy
- For ticket bookings, the WU Ball uses the services of the provider Eventjet Austria, Datascroll Eventsupport GmbH (Eggerthgasse 9, 1060 Vienna). The personal data entered during the ticket booking process will not be passed on to third parties. The transfer of data to Eventjet Austria is based on Art. 6 para. 1 lit. a GDPR (consent) and Art. 6 para. 1 lit. b GDPR (processing for the fulfilment of a contract). You have the right to withdraw your consent to data processing at any time. After revocation, the data will be deleted from the servers.

- By attending the WU Ball, visitors accept that photographs (photos, videos, etc.) may be taken, which may also be used by the WU Ball for various purposes in connection with the promotion of the event. By purchasing a ticket, visitors expressly agree that photographs may be taken of them during or in connection with the event. These recordings may be used without restriction and without compensation with regard to time, place and technical procedures and may also be used for commercial purposes as long as their personal interests are not unreasonably impaired.
4. Order and contract conclusion
- The contract between WU Ball and the customer is concluded exclusively electronically via the online shop or by e-mail.
- The presentation of the products on https://wuball.at does not constitute a binding offer to purchase. The customer only submits a binding offer by means of an express declaration once the necessary order steps have been carried out and all the correct data required in the input mask has been sent in the online shop.
- WU Ball confirms receipt of the order and acceptance of the contract by sending a confirmation email including the tickets to the customer.
- All ticket purchases are binding and cannot be cancelled or changed.
- The WU Ball reserves the right to cancel orders and contracts at any time (unilateral right of cancellation) if the customer violates or attempts to circumvent specific conditions of the WU Ball or the venue. Cancellation can also be made implicitly by refunding the amounts paid less a processing fee of 20% of the purchase price.
- If e-mails were sent by the WU Ball as confirmation and nevertheless, for whatever reason, did not reach the recipient, no responsibility can be accepted for the resulting damage.
- By purchasing a ticket, the customer accepts the house rules applicable at the venue (Hofburg Vienna) and the dress code specified by the WU Ball (ladies: Ball gown or floor-length evening dress (hem covers the floor all around, even with higher shoes, slit up to max. knee height); men: black tailcoat (white jacket), black dinner jacket (jacket, colour does not matter) or black suit with jacket (colour does not matter) – no tie!, class A uniform / gala uniform, black dress shoes). Persons who do not comply with the dress code specified by the WU Ball, which will be brought to the customer’s attention once again during the ordering process, may be refused entry to the event without any right to compensation. Smoking is strictly prohibited throughout the venue.
5. Prices and payment
- The prices at the time of ordering apply. Unless otherwise stated, the prices of the respective products are in euros. No value added tax is charged.
- A ticket is only valid once the purchase price has been paid in full.
- The following payment options are offered: Credit card (VISA, Mastercard), instant bank transfer, EPS.
6. Delivery, use
- The tickets ordered in the online shop are issued exclusively as Print@Home tickets and sent to the e-mail address provided by the customer in PDF form.
- The tickets must be printed out by the customer on an A4 sheet of paper and presented in printed form at the entrance to the event, whereby the customer may only make one printed copy of each ticket. The single-use ticket code on the ball tickets will be validated at the venue by the Hofburg’s electronic code scanner. Ball tickets with a code that has already been cancelled do not entitle the holder to enter the event.
- Admission authorisations may not be misused, copied or altered. Duplication in order to gain unauthorised access to the event for oneself or third parties or to enrich oneself unlawfully is prohibited. Any misuse will be penalised.
- By using the admission authorisation, the customer also accepts these general terms and conditions of the organiser and the house rules of the venue (Hofburg Vienna).
- The tickets are ‘one-way tickets’, i.e. they entitle the holder to one entry and lose their validity when leaving the event.
- If payment for Print@Home tickets issued is not properly received by the organiser or is cancelled by the customer, the organiser reserves the right to cancel these tickets. In this case, the customer will be notified by e-mail to the address provided during the order process.
- The customer must immediately check the tickets received for accuracy and completeness, in particular with regard to the details of the event title, date, time, ticket price and number of tickets. Any complaints must be submitted in writing by e-mail to office@wuball.at within five working days of purchase at the latest. If errors are reported too late, it may no longer be possible to guarantee timely correction before the start of the event, which will prevent admission to the event. The WU Ball assumes no liability for properly delivered tickets. Claims for damages due to non-delivery of Print@Home tickets are excluded, as is compensation for the loss of these tickets.
7. Change and cancellation
- Minor or objectively justified changes to the programme are reserved and do not entitle the holder to return tickets.
- The organiser has no obligation to notify ticket holders of cancellations, postponements or rescheduling due to force majeure. However, it will endeavour to inform customers to the best of its ability.
- The organiser accepts no liability for costs incurred in connection with the cancellation, postponement or relocation of the ball (e.g. hotel, travel, rental or similar costs).
- In the event of cancellation of the ball, a refund of the ticket price can only be requested directly from the organiser (office@wuball.at) within 7 calendar days.
- If the customer fails to request cancellation within the specified period, his claims shall lapse definitively. There is no right of cancellation vis-à-vis the WU Ball if the venue becomes unusable for any reason. This applies in particular if the event has to be cancelled or restricted in whole or in part due to official measures.
- If the ball is cancelled, any advance booking fees, shipping, processing or booking fees already paid and other costs and expenses incurred in connection with the booking will not be refunded, as the agency service is deemed to have been provided.
8. Reimbursement of the purchase price
- Ticket and seat purchases are considered final with the transmission of the confirmation email including tickets in PDF format (see point 4.). The purchase price will not be refunded under any circumstances, nor will an exchange be possible. Likewise, the purchase price will not be refunded if a ball guest is expelled from the venue due to violations of the house rules (or dress code, e.g. ‘non-floor-length’ ball gown).
- There will be no replacement for tickets that have not been used or have only been partially used (e.g. in the event of late arrival), nor for tickets that have been lost.
- The ticket purchase is a distance selling contract in accordance with the Distance and Off-Premises Selling Act (FAGG). Cancellation of the contract is excluded as it is a service in connection with leisure activities and a specific time or period is contractually stipulated (§ 18 para. 1 no. 10 FAGG).
- This means that there is no right of cancellation for the purchase of admission tickets or services associated with participation in the event, such as seat reservations.
9. Disclaimer
- The WU Ball accepts no liability whatsoever to third parties for expenses directly or indirectly related to the booking (e.g. no reimbursement of travel cancellation costs).
- The WU Ball is not liable for damages caused by slight negligence. Care is taken to ensure the smooth operation of the website and software in accordance with reasonable technical standards. However, permanent availability of ticket ordering via the website and software cannot be guaranteed. WU Ball shall only be liable for damages caused by malfunctions, errors or interruptions in the event of wilful or grossly negligent behaviour.
10. Scope of application, place of jurisdiction, law
- Austrian law shall apply to the exclusion of the provisions on international private law and to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
- The place of fulfilment for the delivery of the tickets and for their payment is Vienna.
- The place of jurisdiction for corporate customers shall be the competent court in Vienna, for private customers their locally and factually competent court. Austrian law shall apply to the exclusion of the conflict of laws rules.
11. Written form
- Collateral agreements, amendments, supplements or restrictions to the contract or these General Terms and Conditions must be made in writing to be effective. This also applies to any waiver of this written form requirement.
12. Severability clause
- In the event that individual provisions of these General Terms and Conditions should be and/or become invalid, this shall not affect the binding nature of the remaining provisions and the contracts concluded on the basis thereof. The invalid provision shall be replaced by a valid provision that comes as close as possible to the meaning and purpose of the invalid provision.
